ZOA-2020-03 An ordinance to amend, reenact, and recodify the Arlington County Zoning Ordinance §7.1.3, to permit outdoor cafes associated with a restaurant on private property as a by-right accessory use in the R-C zoning district, and to permit outdoor cafes associated with a restaurant on public right-of-way or easement for public use as an accessory use subject to County Board use permit approval in the R-C zoning district, and for other reasons required by public necessity, convenience, general welfare, and good zoning practice.

SUBJECTEnactment of an Amended and Restated Ordinance to Vacate, with Conditions, a portion of 27th Street S. from S. Nelson Street to the eastern boundary of Part Lot 30, Section I, Green Valley, D.B. 131, PG. 190, Corrected D.B. 575, PG. 399 (RPC # 29-002-003, 29-002-004), and the point that is 7.49 feet east of the eastern boundary of Lot 24, Lots 12 through 39, Resubdivision of Lots 1-17, Green Valley and Subdivision Property of W.S. SUBJECT: Resolution authorizing, if an effort to purchase the easements is ineffectual or unsuccessful, the acquisition, for public purposes and by eminent domain, of the following three public easements over, under, across and through the parcels of real estate known as Parcel A-1 and Parcel B-1, Cherrydale Hill (RPC Nos. 06-001-005 and 06-001-006), shown on plat entitled “Plat Resubdivision of Parcels A & B Cherrydale Hill”, attached to Deed of Vacation, Resubdivision and Rededication dated December 18, 1961 and recorded in Deed Book 1459 at Page 153, among the Land Records of Arlington County, Virginia: 1) an Easement for Public Sidewalk and Utilities Purposes, totaling 889 square feet in area (on Parcel B-1); 2) an Easement for Public Street and Utilities Purposes, totaling 2,470 square feet in area (on Parcel B-1); and 3) a Public Storm Sewer Easement, totaling 5,367 square feet in area (on Parcels A-1 and B-1), all as shown on the plat attached to this Resolution entitled “Plat Showing Easement for Public Sidewalk and Utilities Purposes, and Easement for Public Street and Utilities Purposes Parcel B-1 and Public Storm Sewer Easement Parcels A-1 and B-1 Cherrydale Deed Book 1459 Page 153 Arlington, Virginia,” prepared by Walter L. Phillips Incorporated, dated August 26, 2020, together with all existing storm sewer pipes and associated stormwater facilities currently located within the area of such easements.

SITE PLAN AMENDMENTS:

SP# 46 Jefferson Apartment Group to amend the required streetscape on North Quincy Street in the C-O-A zoning district under ACZO 15.5. Property is approximately 26,000 sq. ft.; located at 4000 Fairfax Drive (RPC# 14-045-003). Modifications of zoning ordinance requirements include: other modifications as necessary to achieve the proposed development plan.  Applicable Policies: GLUP “Coordinated Mixed-Use Development District”, Ballston Sector Plan.

SP# 145 Third Gould Limited Liability Company to amend Site Plan #145 to permit administrative approval of rooftop signs in the C-O Mixed Use zoning district under ACZO § 7.13. Property is approximately 57,579 sq. ft.; located at 2611 Richmond Highway (RPC #34-027-005). Applicable Policies: GLUP “High” Office-Apartment-Hotel; Crystal City Coordinated Redevelopment District.

SP# 145 Gould Property Company to operate a temporary parking lot in the C-O zoning district under ACZO §7.1, §7.13, §15.5. Property is approximately 57,579 sq. ft.; parking lot area located in 2600 block of Crystal Drive; and is identified as RPC# 34-027-034. Modifications of zoning ordinance requirements include modifications as necessary to achieve the proposed development plan. Applicable Policies: GLUP Office-Apartment-Hotel “High”, Crystal City Sector Plan and Crystal City Coordinated Redevelopment District

SP# 167 JBG Smith to construct a new retail space approximately 5,640 sq. ft. in the existing courtyard at 2121 Crystal Drive in the C-O-1.5 zoning district under ACZO §7.1, §7.11, §15.5. Property is approximately 322,901 sq. ft.; located at 2121 Crystal Drive (RPC# 34-020-234, -233). Modifications of zoning ordinance requirements include modifications as necessary to achieve the proposed development plan. Applicable Policies: GLUP “Low” Office-Apartment-Hotel; Crystal City Sector Plan.

U-3592-20-1 Clarendon Popup, LLC for live entertainment and dancing in the C-3 zoning district under AZCO §7.1, §7.19, §15.4. Property is approximately 9,832 sq. ft. located at 3185 Wilson Blvd. (RPC# 15-075-003). Applicable Policies: GLUP Medium Density Mixed-Use; GLUP Note #12.

U-3550-19-1 Lil’s Home Daycare LLC for a family day care home for up to 12 children in the R-6 zoning district under ACZO §5.1, §5.6, §15.4. Property is approximately 7,833 sq. ft.; located at 3617 13th St S (RPC# 26-025-002). Applicable Policies: GLUP “Low” Residential (1-10 units/acre).

U-3551-19-1 McNamara’s Pub and Restaurant for live entertainment in the C-2 zoning district under ACZO §7.1, §7.17 & §15.4. Property is approximately 10,250 sq. ft.; located at 567 23rd Street S. (RPC# 36-018-011). Applicable Policies: GLUP Service Commercial; Crystal City Coordinated Redevelopment District.

FOR THREE YEARS:

SP #194 Sweetgreen Ballston, LLC for an outdoor café in the C-O zoning district under ACZO §7.1, §7.13, §12.9.15, §15.5. Property is approximately 59,099 sq. ft.; located at 3100 Clarendon Blvd. (RPC# 19-002-007). Modifications of zoning ordinance requirements include permitting an outdoor café seating area with a greater number of seats than the indoor portion of the restaurant.
