NOTICE IS HEREBY GIVEN THAT THE PLANNING COMMISSION OF ARLINGTON CO., VA, on March 4, 2019, in Room 307, 2100 Clarendon Blvd. at 7:00 P.M. or as soon thereafter as matters may be heard, will hold Public Hearings on the following cases; and

NOTICE IS HEREBY GIVEN THAT THE COUNTY BOARD OF ARLINGTON CO., VA, on March 16, 2019, in Room 307, 2100 Clarendon Blvd. at 9:00 A.M. or as soon thereafter as matters may be heard, will consider the following cases, after offering the public an opportunity to be heard in a public hearing:

NOTE: Copies of proposed plans, ordinances, amendments and applications, and related planning case materials may be examined in the Zoning Office, Suite 1000; or text of proposed County Code amendments in County Board Clerk’s Office, Suite 300; 2100 Clarendon Blvd., Arlington, VA, 8 A.M. to 4:30 P.M. weekdays. The term Site Plan in this notice refers to Special Exception in County Zoning Ordinance and is not the same as an engineering site plan or construction plans submitted in satisfaction of other codes or ordinances. The terms ACZO and GLUP means Arlington County Zoning Ordinance and General Land Use Plan, respectively.

THE FOLLOWING CASE TO BE HEARD BY PLANNING COMMISSION ONLY:

SUBJECT: PROPOSED ORDINANCE to amend the General Land Use Plan (GLUP) to modify the Special GLUP Study process description in the GLUP Booklet to reflect the proposed process revisions and to amend the Zoning Ordinance §15.1.5.B.d to add Special GLUP Study fees in order to allow for refunds on study fees (not initial review fees) when an application is withdrawn prior to staff commencing work.

SUBJECT: PROPOSED ORDINANCE to adopt a zoning fee schedule to establish new and amended fees for Special General Land Use Plan (GLUP) Studies that achieve greater cost recovery and align with the proposed Special GLUP Study process changes as follows: New fees: (1) applications for a GLUP Amendment without a Special GLUP Study ($8,959, plus $4,371 DES review fee); (2) applications for a GLUP Amendment when a Special GLUP Study has been completed ($3,583, plus $1,748 DES fee); (3) applications for a Special GLUP Study initial review ($4,290) (4) applications for a Special GLUP Study ($17,161, plus $5,625 DES fee); (5) applications for a Supplemental GLUP Study ($6,864, plus $2,250 DES fee); (6) applications for a Special GLUP Study Plus initial review ($7,355, $2,250 DES fee); (7) applications for a Special GLUP Study Plus ($29,419, plus $9,000 DES fee); and (8) applications for a Supplemental GLUP Study Plus ($11,768, plus $3,600 DES fee). Amended fees: (1) applications for Rezonings and General Land Use Plan (GLUP) Amendment (revised to remove the fees associated with the GLUP Amendment. Existing rezoning fees still apply). *An automation enhancement fee of 5 percent will apply to all of the proposed new and amended fees (excluding DES fees).

SUBJECT: PROPOSED ORDINANCE to amend the zoning fee schedule to establish a new fee for Conceptual Site Plan applications with an application fee of $5,800. An automation enhancement fee of 5 percent will apply to the new fee.

ZOA-2019-01 Amendments to the Arlington County Zoning Ordinance §4.1, Public (P) District Use Tables; §5.1, Residential (R) Districts Use Tables; §6.1, Multiple-family (RA) Districts Use Tables; §7.1, Commercial/Mixed Use (C) Districts Use Tables; §8.1, Industrial (M) Districts Use Tables; §11.1, CP-FBC, Columbia Pike Form Based Code District; §12.2, Use Categories; §12.4, Public and Civic Use Standards; §12.9, Accessory Use Standards; §12.10, Short Term Use Standards; §14.3, Parking and Loading; §15.2, Certificates of Occupancy; and §18.2, General Terms Defined to modify child care definitions, amend the maximum number of children allowed in family day care homes from nine to 12, modify the special exception use permit process for family day care homes to allow up to 9 children as a by-right use and allow up to 10-12 children by use permit approval, add use standards for family day care homes, modify the use table for RA7-16 district to allow family day care homes with the same number of children as other R and RA districts, modify the parking requirements for child care programs, and allow flexibility for the County Board to modify parking requirements for center-based child care programs through the special exception use permit process.

SUBJECT: Ordinance to amend, reenact, and recodify Chapter 52 (Child Care Centers, Preschools, Nursery Schools, Parent’s Day Out Programs, and Cooperative Playgroup Programs) of the Code of Arlington County, Virginia, to amend sections 52-1 through 52-32, and to add sections 52-33 through 52-53, including amendment of the staff-to-children ratios and group sizes up to the ratios and group sizes specified in section 52-38.

SUBJECT: Ordinance to amend, reenact, and recodify Chapter 59 (Family Day Care Homes) of the Code of Arlington County, Virginia, to amend sections 59-1 through 59-20, and to add sections 59-21 through 59-55, including amendment of the staff-to-child ratios up to the ratios specified in section 59-38.

SUBJECT: Right of Way Agreement between the County Board of Arlington County, Virginia and Virginia Electric and Power Company for installation and maintenance of a transformer, conduit and cables on property, owned by the County Board, and Ground Leased to the County School Board of Arlington County, to be known as Fleet Elementary School, with an address of 115 S. SUBJECT: License Agreement between the County Board of Arlington County, Virginia as licensor and the Metropolitan Washington Airports Authority as licensee for water tank and equipment room space at the Lee Pumping Station (2400 N. Wakefield St., RPC 05-005-072).

U-3531-19-1 Emerson Doyle (EvolveAll Fitness) to allow martial arts instruction to children at a fitness studio in the C-2 zoning district under ACZO §7.1, §7.17, §12.5.20, §15.4. Property is approximately 70,508 sq. ft.; located at 1058 S. Walter Reed Dr. (RPC# 32-006-031, 032, 033, 034, 035). Applicable Policies: GLUP Service Commercial; Columbia Pike Form Based Code District.

FOR FIVE YEARS:

SP#219 Cafe Asia Restaurant to discontinue a site plan amendment for live entertainment and dancing in the C-O zoning district under ACZO §7.1, §7.13, §15.5. Property is approximately 29,198 sq. ft.; located at 1550 Wilson Blvd. (RPC# 17-004-015, -016). Applicable Policies: GLUP “High” Office-Apartment-Hotel.

Amazon Public Hearing

The Arlington County Board will hold a public hearing on a proposed performance agreement with Amazon at its Saturday, March 16, 2019 Regular Meeting. The Board meets in Room 307 on the third floor at the Ellen M. Bozman Government Center, 2100 Clarendon Blvd. Arlington, Va. 22201. The County Board will consider several other agenda items beginning at 8:30 a.m. The Amazon public hearing is expected to begin at 1 p.m. or as soon thereafter as possible.

Note: Due to broad public interest in the proposed performance agreement with Amazon, the Board encourages those who wish to comment at the public hearing to sign up in advance online. Advance sign up is also available in the County Board Office at 2100 Clarendon Blvd. Room 300 Arlington, Va. 22201 from 8-5 pm. Advance sign-up will close at 4 p.m. on March 15, 2019. Advance online sign-up speakers will be called first. Speaker forms will be available at the meeting starting at 8 a.m., and may be submitted  before the first speaker on this agenda item is called.
