Eligibility Requirements for Drug Court Program

Candidates Must:

  • Have a pending violation of probation on a felony charge and admit the violation
  • Or have a pending felony sentencing hearing after pleading guilty
  • Or be scheduled for a felony disposition hearing where a guilty plea will be entered

 

  •                                                                AND

  • Reside in Arlington County
  • Meet DSM-5 criteria for being drug and/or alcohol dependent
  • Be placed on supervised probation for the felony offense
  • No prior convictions for violent felonies or weapons offenses (as defined in 19.2-297.1) within the past 10 years
  • Not be on probation for violent felonies or weapons offenses (as defined in 19.2-297.1)
  • Have no other pending felony, or jailable misdemeanor offense
  • Not have probation or supervision obligations outside of Arlington County
  • Not be a confidential informant

Referral Process

Referrals to the Drug Court Program may come from the State Probation Department as well as the court, jail officials, defense attorney, or the Commonwealth’s Attorney. 

The Drug Court Administrator coordinates with all Drug Court Team members and the Court to guide participants through the process and funnel participants back to the standard court docket when necessary.

Drug Court is held every Thursday (except holidays) from 8:30 a.m. to 9:30 a.m. in Courtroom 10A of the Arlington County Courthouse
